GLOBAL PROMOTION: FREE KITS FOR PHOTOS (the "Promotion")

OFFICIAL RULES & REGULATIONS ("Promotion Rules")

No Purchase Necessary. Participation in the Promotion constitutes full and unconditional agreement and acceptance of these Promotion Rules, which are final on all matters relating to the Promotion.

1. Promotion Period: The Promotion begins at 12:00:59 p.m. (GMT-06:00, CST) on Friday, December 5th, 2008 and closes at 11:59:59 p.m. (GMT-06:00, CST) on Friday, January 30st, 2008 (the "Promotion Period").

2. Eligibility: This Promotion is open only to anyone worldwide (the "Territory"). No restrictions apply to who may participate in the Promotion.

3. How To Participate: No purchase necessary. Participants should email an image similar to the example provided of the Participant using the BEYOND™ Whitening Accelerator in their dental clinic.

To be eligible, submissions must be received during the Promotion Period. Limit one submission per person. Submissions must be submitted to info@beyonddent.com with a valid street address (P.O. Box addresses cannot be used) and phone number for delivery of products. All submissions will become the property of the Promotion Sponsors and will not be returned. The Promotion Sponsors accept no responsibility for submissions which are lost, misdirected or delayed for any reason. Nor is any responsibility assumed for incomplete submissions, incorrect or inaccurate capture of submitted information, including (but not limited to), malfunction, human error, lost/delayed/garbled internet/e-mail transmission, omission, interruption, deletion, defect, or failures of any telephone, technical, network, online, or hardware or software or any combination hereof.

4. Product Samples: Each Participant will receive one (1) BEYOND™ II Complete Professional Whitening Kit for Tetracycline and Severe Stains (the “Product”) shipped to them at Promotion Sponsor’s cost. The approximate retail value of the Product is US$85.00.

Any fees or other expenses not expressly included in the Product descriptions in these Promotion Rules are the sole responsibility of the Participant.

5. Participants are only eligible to receive one (1) Product.

Participants will be notified within twenty four (24) hours of receipt of their image. Following submission, the Product will be shipped within one to two (1-2) business days to the street address provided by the Participant.

6. General Rules: Each Product must be accepted as distributed and no substitutions of cash or otherwise or transfer of the Product will be made, provided that the Promotion Sponsors may make substitutions of equal or greater value.

Product may not be resold or offered for resale in any manner. Product cannot be replaced if lost, stolen, or destroyed.

By participating in the Promotion, each Participant consents to the use of his/her name, image, photograph, and city of residence by the Promotion Sponsors, without further compensation, for any and all publicity purposes, commercial or otherwise, in all media. The Promotion is subject to all applicable federal, provincial and municipal laws and regulations and shall be governed by the laws of the State of Texas and the federal laws of the United States applicable therein.

By participating in the Promotion, each Participant agrees to be bound by these rules and regulations and all decisions of the Promotion Sponsors, which decisions are final with respect to all matters relating to the Promotion.

By participating in the Promotion, Participants agree to hold harmless and indemnify the Released Parties against any and all liability, damages or causes of action (however named or described with respect to or arising out of either: (i) Participant’s participation in the Promotion; (ii) the receipt or use of the Product distributed herein; or (iii) the administration of the Promotion and distribution of the Product(s) distributed herein.

Participants hereby release, waive and discharge any and all claims of damage, loss or causes of action (including, negligence), including (but not limited to) death, personal injury or loss or damage to property, which the Participant or any of the Participant’s representatives, heirs, next of kin or assignees ("Participant’s Representatives") may have or which may hereinafter accrue to the Participant or Participant Representatives against the Released Parties as a result of the Participant’s participation in the Promotion or the receipt or use of the Product(s) distributed herein.

The following are prohibited and will result in automatic disqualification from the Promotion: (1) non-compliance with these Promotion Rules; and (2) any other act which the Promotion Sponsors determine, at their sole discretion, jeopardizes the integrity of the Promotion.

The Promotion Sponsors may terminate, modify, suspend or withdraw from this Promotion, in whole or in part, at any time without notice for any reason, without liability, at their sole discretion.

The Promotion Sponsors reserve the right to substitute products of equal or greater value and/or to terminate, modify or withdraw this Promotion, in whole or in part (including altering the manner in which the products are distributed), at any time, without prior notice for any reason. In the event a substitute product is given, such item must be accepted as distributed and cannot be exchanged for cash or otherwise. Further, the Promotion Sponsors reserve the right to disqualify any person and void any entries of that person who it believes has tampered with any component of the Promotion, whose conduct or action affects the administration, security or fairness, integrity or proper conduct of the Promotion, or who fails to meet or abide by the Promotion Rules and conditions.

The Promotion Sponsors do not assume any responsibility for tampering, theft, defects, viruses, human errors including negligence, deletions, technical or telephone, computer line, network, server, access providers, computer equipment or software problems, undeliverable messages, computer errors, lost, misdirected, late or incomplete entries or inaccurate capture of information or any online difficulties that may result in damage or malfunction the computer or the failure of the Promotion Sponsors to process any entry and otherwise award any Product. Nor is responsibility assumed for printing errors appearing in these rules or related Promotion materials. In addition, the Promotion Sponsors will not assume any responsibility of any nature whatsoever in all cases where their inability to hold the Promotion or to remit the Product to the Participants results from a cause beyond their control, including Acts of God, weather conditions, strike, lock-out or other labor dispute. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Promotion is a violation of criminal and civil laws, and should an attempt be made, the Promotion Sponsors reserve the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.
